During my tenure in Hong Kong, I managed numerous family court cases. Upon relocating to the UK, I did not particularly anticipate concentrating my practice in any specific area. Yet, to my astonishment, the divorce cases I have handled have outnumbered all others.
My assistant frequently asserts that divorce proceedings in the UK are relatively straightforward to navigate. Initially, I contested this notion, having observed that few Chinese law firms are established primarily on the basis of divorce litigation; most tend to focus on real estate transactions or immigration issues.
Yet, she proved to be correct once again. When considering real estate transactions, our firm’s location in London does not confer a price advantage, especially given the highly competitive nature of the real estate market.
Regarding immigration matters, it appears that individuals from Hong Kong typically seek legal assistance only when complications arise, thereby resulting in family law cases that necessitate the hiring of legal counsel for resolution or advice.
Although the legal frameworks of the UK and Hong Kong bear similarities, it is noteworthy that divorce proceedings in the UK are characterized by greater convenience and expeditiousness compared to those in Hong Kong, a fact that compels many individuals to choose the UK for resolving their divorce issues.
Observing the comments made by netizens, who declare, “Ronald Cheng is getting divorced again; one can ascertain that he is not a good person,” I feel compelled to clarify that I am not attempting to defend anyone. However, after navigating an extensive array of divorce cases, I have come to comprehend that discerning the truth within family matters presents a formidable challenge, even for the most principled judges. Indeed, many individuals pose the question, “If my spouse has been unfaithful, will I be entitled to a greater share of alimony or property?” In reality, common law courts do not engage in moral evaluations; rather, the determination of asset distribution is not predicated upon the perceived character of the individuals involved. The court does not possess the capacity to judge moral worthiness in divorce scenarios.
It is pertinent to note that some individuals may excel in their professional capacities yet experience significant turmoil in their romantic entanglements. We, as a society, have evolved from the previous generation, now afforded a multiplicity of choices, which inevitably gives rise to an array of problems. Relationships today necessitate that both parties engage collaboratively and diligently through both challenges and joys. Should either party lose the impetus to invest in the relationship, its continuation becomes exceedingly difficult. Moreover, in contemporary society, the presence of children no longer guarantees the sanctity of marriage.
